Abstract

The article examines the breach of bank secrecy and the delimitation of the bodies empowered to order such a measure. The exposition starts from the dichotomy between the right to privacy and the public interest, recognizing secrecy as a relative individual right, constitutionally protected, which may only yield upon observance of due process of law. The investigation analyzes the provisions of Law 4,595/64 and Law 7,492/86, examining the action of the Judiciary, the Legislative Branch, the Parliamentary Inquiry Committees, the Tax Authority and the Federal Public Prosecution Service. The text concludes that the breach of bank secrecy may only be obtained through a reasoned judicial order, issued within the scope of a judicial action.
