Abstract

The article examines the jurisdiction to judge crimes related to firearms, established by Law 9,437/97, which repealed article 19 of the Criminal Misdemeanors Law and elevated illegal carrying to the category of crime. The exposition analyzes the new criminal types, distinguishing firearms of permitted use from those of prohibited or restricted use, and examines the jurisdiction of the Federal Court in light of articles 20, 21, 23, 109 and 144 of the Constitution. The investigation sustains that crimes related to the registration and interstate carrying of the weapon affect the service and interest of the Union, attracting federal jurisdiction. The text concludes by delimiting the remaining hypotheses of the State Court.
