Abstract

The article examines the emergence, evolution and decline of the quaestiones perpetuae in Roman law, from the founding of Rome to the cognitio extra ordinem. The exposition reconstructs the historical background, the transition from the sacred character of punishment to criminal jurisdiction and the distinction between crimina and delicta, and analyzes the institution of the first quaestio by the lex Calpurnia, in 149 BC, to judge the extortion of provincial magistrates. The investigation examines the procedure of the quaestiones, the popular accusation, the composition of the judging body, the evidence and the voting. The text concludes by recognizing its merit as the foundation of Roman criminal law.
