The article examines the application of the principle of the natural judge in view of the partial shift of jurisdiction from the State Military Court to the Ordinary Court, brought about by Law 9,299/96. The exposition reconstructs the history of the state military court, the definition of military crime and the change that attributed to the ordinary court intentional crimes against life committed against civilians. The investigation sustains the constitutionality of the norm, dismissing the violation of the natural judge, and examines the immediate application of the procedural law to pending cases, with support from the case law of the Superior Court of Justice. The text concludes by the jurisdiction of the Jury Court and the Court of Justice.
