Abstract

The article comments on a decision by the Second Panel of the Federal Supreme Court that, in habeas corpus, granted the progression from closed to semi-open regime of penalty serving. The exposition records the controversy over jurisdiction to hear the writ and the admissibility of evidence examination in this action, arguing that the restriction on evidentiary discovery does not prevent analysis of the facts necessary to verify illegality. The text analyzes the objective and subjective requirements for progression, sets aside the demand for self-incrimination, and rejects the invocation of the crime's nature and the penalty's length as obstacles. The investigation concludes that doubt about subjective requirements must be resolved in favor of the convict.
