Abstract

The article examines article 327 of the Penal Code, which defines public official for criminal purposes, analyzing the caput, the equivalence of paragraph 1, and the penalty increase of paragraph 2. The exposition argues that the legislator emphasized the public function performed, and not the formal predicates of the public servant, covering position, employment, and function, even if temporary or unpaid. The text analyzes the controversies over the meaning of parastatal entity, arguing that the expression covers autarchies, public companies, mixed-capital companies, and foundations instituted by the public power. The investigation concludes that paragraph 2 contains only a special cause of penalty increase and that the equivalence of paragraph 1 refers to public officials as agents of functional crimes.
