Abstract

The article examines the legal nature of the rule in article 83 of Law 9,430/96 and its repercussions on the criminal prosecution of crimes against the tax order. The exposition starts from questions about the possible extension of the provision's effects, which determines the forwarding of the fiscal representation to the Public Prosecution after a final decision at the administrative level. The text argues that the rule has an administrative nature, aimed at tax authorities, and does not affect the typical definition of tax crimes or the investigative procedures and criminal actions in progress. The investigation analyzes the consummation of material crimes, the definitive assessment, and the nature of the representation. The conclusion states that criminal prosecution remains unconditional.
