Resumen

The article examines the trend of modern criminal procedure to strengthen the Public Prosecution's role in the pre-procedural phase of criminal investigation. The exposition starts from criticisms of the slowness and inefficiency of criminal justice and from the explanatory memorandum of the 1942 Criminal Procedure Code, to argue that change must occur at the legislative level. The text analyzes the German, Italian, Portuguese, French, and Spanish criminal procedure systems, showing that all have entrusted the Public Prosecution with the direction of the preliminary investigation, with the judicial police acting under its guidance and functional dependence. The investigation concludes that the speed and quality of the process depend on the effective action of the Public Prosecution from the inception of the investigation.
