Abstract

The opinion examines a consultation on bills under consideration in the Federal Senate dealing with the definition of military crime and the jurisdictional competence for its prosecution and judgment. It analyzes the classification of offenses into common and responsibility crimes, the definition of military crime left to ordinary law by the 1988 Constitution and the extension of military jurisdiction to civilians. It argues that the legal concept of military crime must be founded on the protected legal interest, the military institutions, and that intentional crimes against life, bodily integrity or health, committed by military personnel against civilians, must be prosecuted and judged by the common justice, concluding that minimum constitutional rules for the protection of civilians are necessary.
