Restorative criminal justice in the jurisprudence of southern, southeast and midwest state courts of Brazil

Abstract

The article aims to analyze collegiate decisions of the State Justice Courts of the South, Southeast and Midwest regions of Brazil, handed down from 2015, not covered by secrecy of justice and in whose summary of the judgment included the term restorative justice. Fifty decisions were analyzed, considering, mainly: the elements used by the courts to understand the concept of restorative justice, the criteria for granting or rejecting the referral of cases to this channel of justice and the legal impacts attributed to restorative practices considered successful. The results point to: the importance of defining the scope of normative incidence regarding the application of restorative justice and the need for clarification about its procedural functioning, so that it is not confused with other institutes or as a means of producing impunity.
