Abstract

The article 1st of the Federal Act n. 13.869/18 states that the criminal offenses on that law can only be committed with special intention. Taking into consideration that the criminal offenses on the Federal Act n. 13, 869/19 protects impartiality, this essay suggests the use of normative thresholds, such as disqualification and recusation to previously gauge the intention in abuse of power offenses.
