The article seeks to visit the little-known national penal literature of self-defense and from this visit identify whether it is possible to think about Brazilian dogmatics outside the idea of a so-called incipient construction. Is it possible to think about self-defense based on Brazilian dogmatics? What did the criminal experts – treated as mere “commentators” – write on the Criminal Code? We started with these questions to begin the bibliographical investigation of nineteenth-century criminal literature and seek to extract everything possible from it to begin to understand the forgotten Brazilian penal literature.
