Criticism to suspension of effectiveness of the art. 3º-a of CPP

The article intend to demonstrate that the injunction of Justice Luiz Fux, at the ADI’s 6.298, 6.299, 6.300 e 6.305, does not contain explicit fundamentals that would allow the suspension of the effectiveness of art. 3º-A, CPP. Besides violating the constitutional principle of motivation, the injuction is inserted in what could be called counter-reform movement, in which beneficial providences in favor of the adversary system are simply set aside, maintaining the inquisitorial mentality and practices in the Brazilian criminal procedure.
