Abstract

The article analyzes the new criminal offense introduced in Law 11.343/06 by the so-called Anti-Crime Package as the ultimate expression of legislative´s ineptitude, considering that, by establishing the “undercover police agent” figure as element of the offense definition, the legislator ended up making a useless norm, since the perpetrator´s intent must necessarily encompass that circumstance.
