This essay aims to examine the connections between the State of exception and the exercise of punitive power and the way how, in current time, mechanisms of exception permeate democracies and resonate on criminal guarantees, as well as the legitimizing role performed by the “criminal law of the enemy” doctrine on this dynamics.
