The legal-penal hermeneutics that Brazil has joined is based on the search for legal certainty ensured by legality. In this sense, the judgment of ADCs 43, 44 and 54, although it has honored the state of innocence, did so with exaggerated and unnecessary argumentative effort, with na impressive five votes diverging. Therefore, it is necessary to return to the tradition of a legal-penal hermeneutics.
