Abstract

This paperwork discourses about illegitimacy of the criminal contravention for the exploitation of gaming, according to the theories of the protection of legal interests and criminal paternalism, located in the context of the criminal proportionality, concluding that the contraventional statute was not embraced by the 1988 Constitution.
