This article aims to critically analyze the lack of democracy in the production of norms in the Brazilian penal system. The proposed problematic is interested in knowing “who are the people who produce the penal norms and how representative of the population are they?”. With the hypothesis that, despite initiatives to correct course, there is a lack of adequate representation in the articulation of public policies in the control and punishment system. Based on the qualitative method, guided by a hypothetical-deductive approach, we intend to demonstrate that there is still a lot to be done if we want the Brazilian standardization to be in the spectrum of what is called a democratic environment.
