Abstract

For the present work, a brief retrospective on criminal legislation was made, analyzing the way in which women were inserted in the legal system and how conducts, previously legitimated, were responsible for justifying gender inequality and violence against women. It was observed how the social context and the patriarchal structure influenced the elaboration and application of laws and that these still impact today in violence related to gender. We also highlight how the State was responsible for contributing to gender violence and how its operators continue to perpetuate such violence in an organic way.
