Abstract

The purpose of this essay is to analyze the nature of the crimes present in Brazil’s “Law in Defense of the Democratic State of Law”, demonstrating how those crimes cannot be considered simply common crimes, and must be treated as political crimes, since they are crimes against the Rule of Law itself; to that end, Brazil’s Federal Constitution specific provisions that support the existence of political crimes in our legal system were taken into account, as well as the specific nature of this legislation that was designed, precisely, with the purpose of protecting Brazilian democracy against its enemies or political adversaries.
