The article is intended to scrutinize the legislative evolution in the field of crimes against State security in Brazil, with a specific focus on the paradigm shift observed between Law 7.170/1983 – which was enacted under the auspices of the military regime – and the most recent Law 14.197/2021 – passed with the goal of adjusting the treatment of said crimes with the guiding principles of the Federal Constitution of 1988 and the Democratic State and Rule of Law. The work also seeks to analyze if, one year after the promulgation of the new law, its spirit remains untouched by the daily practice of law.
