Abstract

The aim of this paper is to analyze, from the theoretical framework of Guarantees Theory (as developed by Luigi Ferrajoli), the role of the Public Prosecutor’s Office as a guarantee institution, highlighting how, in addition to holding the power to initiate criminal proceedings, it expands its functions to include external oversight of police activities. Based on Ferrajoli’s guarantee principle that all power tends toward abuse, the text discusses the importance of the Public Prosecutor’s Office in overseeing the legitimacy of police actions, given that unrestrained police conduct jeopardizes the procedural and criminal guarantees established by the constitutional framework.
