The coexistence of the principle of sovereignty of verdicts with the guarantee of the presumption of innocence
reflections in the light of the Federal Constitution and Theme 1,068 of the Federal Supreme Court

The Jury Court, enshrined in art. 5, item XXXVIII, of the Federal Constitution of 1988, represents the materialization of the principle of sovereignty of verdicts, a fundamental pillar of the democratic system. On the other hand, the guarantee of the presumption of innocence, inscribed in art. 5, item LVII, also occupies a central position in the Democratic Rule of Law, ensuring that no one will be considered guilty until the final criminal sentence is reached. The basis also exists in the American Convention on Human Rights, in particular, in art. 8.2.h. This apparent conflict was the subject of analysis by the Federal Supreme Court in Theme 1,068, which discussed the constitutionality of the immediate execution of the sentence after conviction by the Jury Court.
