The virtual participation of the accused in the Jury Trial

A recent decision by the Supreme Court authorized the immediate sentence execution in jury trials, understanding that the sovereignty of verdicts allows for the mitigation of the presumption of innocence. Consequently, some defendants, who are currently free, are opting to participate in the hearing via videoconference, fearing they will be arrested at the end of the plenary session. Despite the objections of the parties (notably the Public Prosecutor's Office and the assistant prosecutor), the principles of full defense and adversarial proceedings include the right to be present, to confront, and to be heard, as well as their day in court, even online. They have the right to appear in person or virtually.
