This article investigates an early legal precedent for the principle of criminal legality in Portuguese law: a Suplicação decision from the mid-18th century. It analyzes how this decision, prior to the formulations of Beccaria and Feuerbach, enshrined the taxability of criminal laws, refusing analogy to incriminate conduct. The study contrasts this innovation with the hostile context of Pombaline absolutism, which later violated it, and with contemporary doctrinal reticence. It concludes that the seat represents a pioneering, albeit fragile and forgotten, affirmation of strict legality, the seminal value of which has been rescued by legal historiography.
