The concept of authorship in Brazilian Criminal Law

The article examines the concept of authorship in brazilian criminal law, contrasting the unitary theory, based on causal equivalence, with differentiating theories that, starting from a restrictive conception of authorship, distinguish the various forms of participation in a criminal offense. Based on a brief historical analysis, it is demonstrated that the Penal Code does not impose the adoption of the unitary theory, being, in fact, incompatible with it. It is argued that only the restrictive concept of authorship, guided by the principles of legality and proportionality, preserves systematic coherence and the fair differentiation between perpetrators and participants.
