Restrictions on liberty and physical integrity of questionable constitutionality

This editorial critically assesses Law 15,272/2025, highlighting its insufficient technical grounding, potential constitutional violations, and its likely contribution to the expansion of Brazil’s already critical mass incarceration. The newly created “recommendations” for converting arrests in flagrante into preventive detention and the vague criteria for assessing dangerousness risk legitimizing judicial arbitrariness. Moreover, the compulsory collection of biological material during custody hearings raises serious concerns regarding privacy, informational self-determination, and the absence of a specific data-protection framework for criminal matters. The article calls for strengthened judicial oversight and broader civil-society engagement in the legislative process concerning criminal justice.
