The chain of custody of digital evidence

This article analyzes the chain of custody applicable to digital evidence, emphasizing the converging positions of legal scholarship and computer science literature that highlight the need for heightened safeguards in light of the intrinsic volatility of such evidentiary material. It further scrutinizes the markedly divergent approaches adopted by the Superior Court of Justice, revealing significant inconsistencies that call for doctrinal and jurisprudential harmonization. Grounded in the understanding that there is a right to expert evidence, it is argued that the standardization of this matter should adhere to strict rules regarding the evidentiary custody of digital evidence.
