The erosion of the instrumental-anthropocentric key of the progressive prison regime principle in sentence execution

This article examines the process of erosion of the progressive prison’s regime principle from the perspective of the State's instrumental-anthropocentric key, drawing on Locke’s philosophical foundations and Engels’ critique of the prison system. The authors analyze Brazilian legislative evolution, from the Heinous Crimes Law (1990), through the Anticriminal Organization Package, to the Raul Jungmann Law, demonstrating how successive restrictions on regime progression have replaced the resocializing ideal with a logic of individual neutralization. It concludes that such changes represent an abandonment of the fundamental principle that the State cannot give up on the citizens, transforming the punitive system into a mere instrument of incapacitation.
