Environmental macrocriminality and the new legal framework to combat organized crime in Brazil

This article analyzes Act 15,358/2026 in addressing organized environmental crime in Brazil. It examines environmental macrocriminality linked to illicit economic chains, such as illegal mining, deforestation, and wildlife trafficking, through the lens of green criminology. It concludes that, although the legislation represents a normative advancement, its punitive rationale is insufficient to address the structural causes of environmental degradation and may reproduce penal selectivity. Therefore, it advocates for the development of a sustainable environmental criminal policy, integrated with preventive, regulatory, and environmental justice measures.
