To incite or to narrate?
The interpretation of article 3, II, of the Anticriminal Organization Law in light of speech act theory

This article examines the offense of promoting structured social domination (Article 3, II, of Law No. 15,358/2026), which criminalizes the distribution of material intended to incite others to commit the acts set forth in Article 2. The study adopts a qualitative doctrinal legal methodology, employing a deductive approach, bibliographic review, and systematic-pragmatic interpretation of the criminal provision in light of speech act theory. It argues that the intent to incite may be established objectively through the identification of the message’s directive illocutionary force, without requiring inquiry into the speaker’s mental states. The central issue is to define criteria for assessing the specific subjective element while distinguishing it from artistic expression. The article concludes that the offense requires proof of a directive speech act aimed at inciting the commission of the acts described in Article 2.
