a mistake of labels and flagrant unconstitutionality in the Anti(pro)-Criminal Organization Package

This article analyzes the penalty imposed for the new structured social domain crime and the hardening of penal execution introduced by Act 15,358/2026. It starts from the tension between the constitutional guarantees of individualization of punishment and the prohibition of perpetual sentences and the introduction of increasingly higher penalties, associated with new, longer and more restrictive regimes for serving a sentence. It argues, by constitutional imperative, that a formally temporary penalty cannot materially represent, by its quantum and/or manner of execution, a disproportionate sanction, a true sentence of life imprisonment.
