The article intends to discuss the nature of the sanctions imposed on legal entities under the Family Planning Law (Law 9.263/1996). This legislative strategy puts into question whether the legislation intended to present an authentic modality of corporate criminal liability or whether, on the contrary, it took advantage of an effect of the conviction that, although it falls on collective entities, are derived from the responsibility of individuals.
