The rules concerning the decision of closure of the police investigation: what changes with the Act 13.964/19?

The present article is about the new rules introduced in the art. 28, from the Criminal Procedure Code, brought by the Law 13,964, of 12.24.19, which is currently suspended by the Brazilian Supreme Court Minister Luiz Fux’s decision, in the Direct Unconstitutionally Action 6,395. It analyzes the fundamentals for changing the “nature” of the act of closing the police investigation, by the new text of the legal provision, and its consequences to the rules’ interpretation in the structuring of the criminal procedure.
