This article aims to address issues involving the differences between letter rogatory and mutual legal assistance requests, in the light of the decision of the STJ issued in Constitutional Complaint 44565. The current existing criteria in the Brazilian legal system do not allow identifying clear distinctive elements between the two institutes, which leads to an overlap of enforcement and uncertainty. To better understand the theme, a brief history of the institutes and the jurisprudential changes that resulted in the current confusion between them is made.
