The article analyzes the hierarchical and bureaucratic apparatus of the Roman-Germanic justice system and the Anglo-Saxon horizontal and parity structure. It seeks to understand the rationality of decision-making processes in each model and verifies if when implementing consensual justice, Brazil has adopted a legal culture that is less dependent on the official pronouncement of the State. This evaluation allowed knowledge of the conditions under which we will receive the non-persecution agreement, as well as to promote a more critical reading of the new legislation.
