Aiming to clarifying preliminary notions to the institute and guiding specific studies on punishability, this analysis, based on deductive and dogmatic methods, proposes a legal-criminal perspective, through which it is possible to determine, the appropriate systematic location of punishability within the scope of the punishable fact, reaffirm its independence in relation to the crime and establish it as an suitable place for the valuation of criminal policy and related to the preventive purposes of the penalty.
