Abstract

The article discusses the concepts of function and power to define the abuse of authority against the citizen. What's more, the divergence in the interpretation of the law or in the assessment of facts and evidence by the authority excludes the wrongdoing in a more radical way than the error of prohibition or type, which depend on the avoidable/inevitable nature of the error. Thus, it is possible to say that the legislator criminalised with one hand, but decriminalised with the other, creating a strange criminal law of the friend.
