Recent court rulings by higher courts seem to indicate a paradigm shift in the instrumentation of Habeas Corpus, which has allowed it to broaden its effectiveness in protecting the fundamental right to liberty, thereby counteracting the punitive wave that insists on undermining the principles inborn the democratic state of law.
