The Superior Court of Justice and binding precedents in Criminal Law and Criminal Procedure

The article examines how the Superior Court of Justice is applying binding precedents after the advent of the new Code of Civil Procedure in criminal and procedural criminal law. The problem presented for the research was whether the Superior Court of Justice, as a precedent court, respects horizontal and vertical binding precedents, as well as producing binding precedents for the uniformity of law and, therefore, brings greater legal certainty to the legal system. A questionnaire was presented to the Ministers of the Superior Court of Justice, as well as an analysis of cases judged by the special court and the third section. In the end, it is concluded that there is an ongoing change in the Brazilian legal system, as the ministers are applying the binding precedents in their judgments, which may lead to greater predictability, equality and legal certainty.
