The restriction of downgrading imprisonment in the “anticrime bill” and the incapacitation logic: a brief discussion

The present article aims to discuss the criminal policy behind the so-called “anti-crime bill”, its proposal to harshen the present rules for downgrading imprisonment and its relation with the idea of a specific deterrence through incapacitation. Furthermore, it is argued that this logic tends to weaken the principle of legality in criminal law. Finally, the paper still indicates a possible conflict between the new law and the Brazilian Supreme Court precedents.
