The nonhuman animal as a depersonalized right-holder and the Theory of Legal Interest

This article addresses the change in the legal nature of the nonhuman animal proposed in House of Representatives’ Bill No. 27 of 2018 and its effects on the criminal law, based on the legal interest theory. Devoid of the quality of property, the animal no longer integrates the legal interests of the patrimony and, once understood as a depersonalized right-holder, stands out as an autonomous figure within the legal interest of the environment, both negative consequences from the point of view of criminal protection. The suggested alternative interpretations are (i) the search for substantiation for the depersonalized right-holder to continue to integrate the patrimony or (ii) its tutelage through new criminal categories without a legitimate legal interest, both questionable possibilities. As for the environment, the abstract character of the crimes should not be ignored to avoid defects in proportionality and legislative technique.
