Abstract

After the public debate caused by the obstacles to legal abortion imposed on a 10-year-old girl victim of sexual violence in Espírito Santo in August 2020, the Ministry of Health issued ordinance No. 2,282, which added even more barriers to the provision of this service by imposing compulsory notification to the police. The ordinance violates the rights of girls and women to health, dignity, intimacy, privacy and physical and mental integrity, in addition to violating the obligation of professional secrecy in the context of access to health. The episode raises the debate about the necessary independence of the health and criminal justice systems in the fight against sexual violence.
