Abstract

The proliferation of the COVID-19 brought several legal texts with containment measures of deases. So emerged the question if those who disobey these new legal order should be charge by the crime descript in the art. 268 of brasilian penal code or art. 330, this beacause those two crimes aims to protect the legal text. That way, for the crime descript in the art.268 wont be unusable, this excerpt propose that these crime is sustained by the interprtation of duty violation crimes, above all, because they require a active conducts of the citizen to guarantee the contention of the dissemination of the virus. In conclusion, the gola is to find a dogmatic funcionality for the crime of breach of health rule.
