Resumen

Este estudio examina la aplicación del derecho internacional de los derechos humanos (DIDH) en los territorios ocupados, centrándose en las obligaciones del ocupante bajo el principio de "control efectivo". El análisis de las resoluciones de la ONU, las decisiones de la CIJ y las prácticas estatales revela barreras sistémicas: sesgo político en el Consejo de Seguridad, sanciones inaplicables y aplicación fragmentada. Casos como el de los territorios palestinos ilustran la brecha entre las normas jurídicas y la realidad: violaciones como los asentamientos ilegales y la denegación de servicios esenciales persisten con impunidad. Las reformas propuestas incluyen el levantamiento del veto del Consejo de Seguridad sobre las votaciones en materia de derechos humanos, el empoderamiento de la CPI para investigar los crímenes de ocupación y el despliegue de misiones permanentes de observación de la ONU. El objetivo es armonizar la teoría jurídica con la práctica, protegiendo a las poblaciones vulnerables bajo ocupación.

Belal Ali AbuHasballah, East China University of Political Science and Law, Shanghai, China

Belal A.S. Abuhasballah es un abogado palestino con una Licenciatura en Derecho General (especialización en Derecho Internacional Humanitario) y una Maestría en Derecho Público por la Universidad Islámica. Actualmente cursa un Doctorado en Derecho Internacional en la Universidad de Ciencias Políticas y Derecho de China Oriental. Cuenta con certificaciones en inglés (Nivel 12), chino (HSK4), ICDL y TOT. Belal cuenta con experiencia práctica como abogado colegiado, ha participado en congresos jurídicos internacionales y cursos de verano en la Universidad de Fudan sobre la Iniciativa de la Franja y la Ruta, y ha participado activamente en programas de derechos humanos y justicia de género. Ha publicado varios artículos académicos sobre derecho internacional, centrándose en el conflicto israelí-palestino, y es un apasionado del derecho internacional público, los derechos humanos y la defensa jurídica.
