Criminal megatrials and procedural negotiations:
a fourth-way to solve criminal conflicts

This paper tries to present an alternative to noticeable problems in extensive criminal lawsuits know as criminal megatrials. In them, the parties great concern is related to petition deadlines and probatory activity. This dissatisfaction creates a procedural conflict, given the lawmaker’s inertia to create mechanisms to solve the specific features of this type of criminal lawsuits. As an alternative to these problems, an argument is made in favor to realizing of procedural negotiations, allowing the parties—and only them—to adapt the procedural rite to serve the specific cases’ particularities.
