The problem of this article is to carry out an analysis of the constitutionality aspects of Bill 1,904/24, which intends to criminalize abortion carried out as a result of rape, after twenty-two weeks of pregnancy. To do so, objectively understand the (un)constitutionality of the aforementioned project, through an analysis of the constitutional principles and the possible impacts of the project on the Brazilian reality. A descriptive methodology was used to present all aspects relating to the constitutional principles involved, through the in-depth use of constitutionalist literature, allowing a dogmatic analysis regarding the legislative project.
