Abstract

This article subject is the criminal defensive investigation, specifically in the context of its practical application in Brazilian forensic daily life. The article answers the questions not answered by the current legislation, through an analysis based on the lawyers' prerogatives, as well as paying attention to any problems that may arise as a result of the practice of criminal defensive investigation. After all, the importance of the institute is explained and, at the same time, the notion that its application cannot give rise to an eventual inversion of the burden of proof or mitigation of the in dubio pro reo principle.

O artigo aborda a temática da investigação criminal defensiva, especificamente no âmbito de sua aplicação prática no cotidiano forense brasileiro. Busca-se responder às lacunas deixadas pela legislação, através de uma análise pautada nas prerrogativas dos advogados, bem como com atenção a eventuais problemas que podem vir a surgir em decorrência de sua prática. Ao cabo, explica-se a importância do instituto e, ao mesmo tempo, a noção de que sua aplicação não pode ensejar eventual inversão do ônus da prova ou mitigação do princípio in dubio pro reo.
