Abstract

The 1983 national security law constitutes legislation specific to the regime of prior transition to the rule of law. If, on the one hand, some articles confront the current constitutional order, on the other hand, some provisions must be interpreted in accordance with the Federal Constitution, aiming at protecting acts that undermine the functioning of democratic institutions. In search of improvement, there are bills foreseen provisions in Defense of the Democratic Rule of Law. However, they need to be improved, either with new wording or with the inclusion of rules that protect new attacks on democracy.

Professor Titular de Direito Penal no Departamento de Direito Penal, Medicina Forense e Criminologia da Faculdade de Direito da Universidade de São Paulo. Foi Ministro da Justiça em 2002. Autor de diversos livros de doutrina, coletânea de pareceres jurídicos e vários artigos em diversas revistas jurídicas brasileiras e estrangeiras. Membro da Academia Paulista de Letras (cadeira nº 2), bem como da Real Academia de Jurisprudencia y Legislacion. Advogado. Presidente da Comissão de Mortos e Desaparecidos do Regime Militar de 1.995 a 2001
