Abstract

The defensive investigation gained momentum with the Project for the New Code of Criminal Procedure, which seeks to introduce this institute into Brazilian law. The idea that the defense can, on its own initiative, carry out investigative activities, raises certain questions about the legitimacy of this new model of investigation. In this work, we will try to demonstrate that defensive investigation has solid theoretical foundations, and that the criticisms addressed to it analyze the phenomenon in a superficial way, neglecting all the virtues that this institute can offer to the Brazilian criminal procedure.
